"Third-Party Content" refers to any information, media, or promotional materials provided by Clinics, Users, or external parties that are displayed on the Hipocs Website. Hipocs does not control or verify the accuracy of such content.

Hipocs facilitates the booking process between Users and Clinics by providing an online platform where Users can browse, compare, and book treatments. However, Hipocs is not a party to any agreements made between Users and Clinics, and all bookings are subject to the Clinic’s own terms and conditions.

Payment of a deposit does not guarantee medical suitability for treatment. Final eligibility is assessed by the Clinic.
If a User is deemed unsuitable for treatment upon consultation, refund policies will be determined by the Clinic.

Users are responsible for ensuring that all personal and medical information provided on the platform is accurate, truthful, and up to date. Providing false or misleading information may result in suspension or termination of access to the platform.
When booking a treatment through Hipocs, Users must adhere to the Clinic’s policies regarding:

Payment terms, including deposits and final payments.

No Liability for Termination: Hipocs is not liable for any damages, losses, or claims arising from the termination or suspension of an account.
Users and Clinics who believe their accounts were suspended or terminated in error may appeal by contacting support[at]hipocs.com. Hipocs will review appeals on a case-by-case basis, but reinstatement is not guaranteed.
Upon termination:
All rights granted under these Terms & Conditions immediately cease.
Users and Clinics must discontinue use of the platform.
Hipocs may retain certain information in compliance with data protection laws and regulatory requirements.
By using the Hipocs platform, Users and Clinics acknowledge and accept Hipocs’ right to enforce account suspensions or terminations where necessary.
These Terms & Conditions, along with any disputes, claims, or controversies arising from or related to the use of the Hipocs platform, shall be governed and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
Users and Clinics acknowledge that their use of the Hipocs platform may also be subject to additional local, national, or international laws and regulations depending on their jurisdiction. It is their responsibility to ensure compliance with all applicable legal obligations.
Hipocs encourages Users and Clinics to resolve disputes amicably through direct communication. If an issue cannot be resolved informally, the following dispute resolution procedures apply:
In the event of a dispute, Users and Clinics agree to first attempt to resolve the matter through good-faith negotiation.
If the dispute remains unresolved after 30 days of negotiation, either party may request mediation before proceeding to legal action.
Mediation shall be conducted in Amsterdam, Netherlands, in accordance with Dutch mediation regulations.
The costs of mediation shall be shared equally between the parties unless otherwise agreed.
If mediation does not result in a resolution, the dispute shall be submitted to binding arbitration under the following conditions:
Arbitration will be conducted by a single arbitrator under the rules of the Netherlands Arbitration Institute (NAI).
The arbitration proceedings shall take place in Amsterdam, Netherlands.
The arbitration shall be conducted in English.
The decision of the arbitrator shall be final and binding on both parties.
The costs of arbitration shall be borne by the losing party unless otherwise determined by the arbitrator.
Notwithstanding the arbitration clause, Hipocs reserves the right to seek injunctive or equitable relief in Dutch courts where necessary to prevent unauthorized use, fraud, data breaches, or violations of intellectual property rights.
If arbitration is deemed inapplicable or unenforceable in a particular dispute, Users and Clinics agree that all legal proceedings shall be brought before the courts of Amsterdam, Netherlands, which shall have exclusive jurisdiction.
Users and Clinics agree that any disputes with Hipocs shall be handled on an individual basis and shall not be combined into any class action, collective lawsuit, or representative proceeding.
To the extent permitted by law, Users and Clinics agree that any claim or cause of action arising from or related to their use of the Hipocs platform must be filed within one (1) year from the date the claim arose. Failure to do so shall result in the claim being permanently barred.
By using the Hipocs platform, Users and Clinics acknowledge and accept the dispute resolution framework outlined in this section.
Hipocs reserves the right to update, amend, or modify these Terms & Conditions at any time, without prior notice. Any changes will become effective upon publication on the Hipocs website.
Users and Clinics acknowledge that it is their responsibility to regularly review these Terms & Conditions to stay informed of any updates. Continued use of the Hipocs platform after modifications are published constitutes acceptance of the updated Terms & Conditions.
Hipocs may, at its discretion, notify Users and Clinics of significant changes via email or through platform notifications.
Minor updates, clarifications, or editorial modifications may be made without direct notice.
If any changes materially impact Users’ or Clinics’ rights or obligations, Hipocs will provide a 30-day advance notice before the changes take effect, except where immediate changes are required by law or to protect the integrity of the platform.
By continuing to use the Hipocs platform after changes take effect, Users and Clinics expressly acknowledge and accept the revised Terms & Conditions. If a User or Clinic does not agree with the changes, they must cease using the platform and request account termination.
